NOTICE OF CEASE AND DESIST AND DEMAND RE: UNLAWFUL BILLING OF A QMB-PROTECTED MEDICARE BENEFICIARY Patient: Marlene Scott DOB: 04/26/1953 Medicare / Member ID: XXXXX7627 Insurance: Medicare with QMB (Qualified Medicare Beneficiary) status Secondary / Managed Plan: UnitedHealthcare Medicare Advantage This serves as formal notice that your offices have repeatedly and unlawfully billed a Qualified Medicare Beneficiary (QMB) for amounts explicitly prohibited by federal law, despite: • Verified QMB status • Verified payments made by UnitedHealthcare • Repeated verbal and in-person notification • Presentation of QMB / Medicaid proof • Confirmation from all three insurance entities involved This conduct must cease immediately. FEDERAL LAW & MEDICARE RULES (NON-OPTIONAL) Under federal Medicare regulations: Providers may not bill QMB beneficiaries for Medicare-covered services, including coinsurance, copayments, or deductibles, regardless of claim status, referral issues, or authorization disputes. This prohibition applies even when a claim is denied, even when prior authorization was not obtained, and even when the provider believes payment was insufficient.Billing disputes are between the provider and the payer — not the patient. The Medicare Handbook (Section 7 – Medicare Savings Programs) explicitly states: • QMB beneficiaries cannot be billed • Bills issued in error must be withdrawn • Continued billing may be reported to CMS, Medicaid, and oversight authorities PATTERN OF IMPROPER CONDUCT Your offices have: • Issued multiple bills claiming non-payment Asserted claims were “denied” when, in fact: Paid claims were duplicated, or Claims were denied due to provider-side authorization failures, and Double Billing errors • Continued patient billing after notice Created ongoing distress for an elderly Medicare beneficiary This pattern raises serious concerns regarding: • Medicare billing compliance • Improper patient collection practices • Elder financial harassment DEMANDS (REQUIRED ACTIONS) You are hereby directed to take the following actions without delay: 1. CEASE AND DESIST all billing, invoicing, statements, collection activity, or payment requests directed to Marlene Scott. 3. UPDATE YOUR RECORDS to reflect a $0.00 patient balance. 4. ISSUE WRITTEN CONFIRMATION (by mail) • The balance account is $0.00 • All patient billing has stopped • CORRECT INTERNAL BILLING PRACTICES to prevent future violations involving QMB beneficiaries. • PRESERVE ALL BILLING RECORDS AND COMMUNICATIONS related to this matter. The following actions will proceed without further notice: PUBLIC DOCUMENTATION & REPORTING 1. Public Review Disclosure • A factual, evidence-supported review will be posted publicly on Google Reviews for: ■ Ennen Eye Center ■ Executive Park Surgery Center. All information shared will be verifiable, accurate, and documented. 2. Better Business Bureau (BBB) Complaint A formal BBB complaint will be filed detailing: ■ Improper billing of a QMB beneficiary ■ Failure to rectify billing after notice ■ Pattern of non-compliant billing practices ■ Elder financial distress caused by repeated invoicing. Supporting documentation will be attached. CLARIFICATION: This notice does not constitute defamation, coercion, or harassment. It merely provides notice of lawful consumer reporting and factual disclosure should this issue remain unresolved. You have been given ample opportunity to correct your records privately and professionally. DOCUMENTED NOTICE: This constitutes formal notice of intent to escalate through all federal, state regulatory agencies, and all public consumer channels if compliance is not achieved. ( A detailed Cease and Desist was sent to your offices via certified mail 12/2025.) Notices were disregarded by both Ennen Eye Center and Executive Park Surgery Center. Please be advised that this review is one small part of the escalation process.

This past Friday was the 2nd time I’ve been to this surgery center, the first time was 2 years ago for cataract surgery and they actually remembered me. And they have called me 3 times since Friday just to check on me and ask how I’m doing, this is impressive! Not to mention the wonderful way I was treated while there, they are just awesome!

I recently had cataract surgery on both eyes. My surgeon Dr. Chris Rodriguez was the best! He is friendly, calming and not full of himself like some doctors can be. Answered all my questions and explained all my options and what was going to happen. He did the original consult and the final surgery on both eyes. I did have a scheduling issue on one eye, but they worked through this with me and got me taken care of in spite of the error. The procedures were both fast and painless. The results are unbelievable, I can see like I did 20 years ago and only need a very slight prescription for distance and correction for reading and computer use. I was wearing a very strong prescription with trifocals and still could not see clearly. The entire staff was 5 star. The process moves at a fast pace, but they are thorough and take sufficient time to explain what is going on. I do not remember all the names, but they are all spectacular. I am prone to extreme anxiety attacks and "white coat syndrome", the fast pace by the staff did not allow me time to dwell on my anxiety. This was the first time that I have not had to have a sedative before going for any sort of surgery. I would highly recommend Dr. Rodriguez and the staff at Executive Park Surgery.

My husband had sinus surgery done today. Dr Marsh and the anesthesiologist took good care of him. All the nurses were very nice. The receptionists at the front desk were nice as well. One of them even handed my one year old daughter a box of crayons and a coloring book with stickers because she was extremely fussy and tired while we were waiting. I so appreciate that. The facility was very clean. They explained everything in a way that was easy to understand and I would definitely recommend this place

This surgery center is clean and the medical staff is great (nurses & doctors). However, the primary female working at the front desk was an arrogant, haughty know-it-all who was incredibly rude to the client and to me, the driver. She refused to accept or even look at a fully legal, signed and witnessed Advanced Directive document that was clearly marked “Durable Power of Attorney,” AND she did it in such a way as to intimidate and ridicule the client. If an emergency had occurred, I believe the center would have had a lawsuit on their hands. The second lady did nothing to mitigate this behavior and later asked two of the three people awaiting the client to leave. We did have a couple of moments of being too loud but there was no one else in the waiting room. We would have apologetically quieted down if she had asked. I hope I NEVER see the inside of this place again!
